1. ACCEPTANCE OF TERMS

By accessing smokedoutfitness.com, our Shopify store, or purchasing any product (apparel, digital, 3D printed), you agree to these Terms, our Shipping Policy, Return Policy, and Privacy Policy. If you do not agree, do not use the site. You must be 18+ to purchase.

2. INTELLECTUAL PROPERTY

All content is owned by Smoked Out Fitness - including Piston Fist logo, Weights Fist logo, "Built in the Fire Proven in the Gym", "Smoked Out Fitness", vertical spine designs, photos, videos, and 5-Day Split PDFs.

You may NOT:

  • Copy, reproduce, or sell our designs (fist, weights, smoke swirl) without written permission
  • Use our logos on your own apparel
  • Resell our digital training plans

Purchasing a product does NOT transfer IP rights. You get the physical item, we keep the design. Any infringement will be pursued under US copyright law.

3. PRODUCTS & PRICING

  • Apparel: Made-to-order via print partners. Colors may vary slightly from screen. Sizing charts are provided - measure yourself, we are not responsible for wrong size ordered.
  • Digital Products: Training plans are for personal use only. Not medical advice. Consult a physician before starting any program.
  • 3D Prints: Printed in-house, minor layer lines are normal and not a defect.

We reserve the right to change prices, cancel orders for pricing errors, or refuse service to anyone. All prices in USD.

4. FITNESS DISCLAIMER

All training information, workouts, and PDFs are for educational purposes only. You assume all risk of injury. Smoked Out Fitness, Kerly LaBranche, and affiliates are not liable for injuries. Consult your doctor before starting. If you have pain, stop.

5. CUSTOM / BESPOKE GOODS NOTICE

Per FTC rules and your old 2020 terms: Apparel printed with your chosen size/color after order is considered custom/bespoke. Other than faulty/defective items, all sales are final. See Return Policy.

6. LIMITATION OF LIABILITY

To the maximum extent permitted by Maryland law:

  • Our total liability for any claim arising from your purchase/use of site shall not exceed the amount you paid for that product ($50 minimum floor from prior terms).
  • We are not liable for indirect, incidental, or consequential damages, loss of gains, gym progress, etc.
  • Site provided "AS IS" - we do not guarantee uninterrupted access.

7. INDEMNIFICATION

You agree to indemnify and hold harmless Smoked Out Fitness, its owner, employees, and print partners from any claims, damages, or expenses arising from your use of products, violation of terms, or violation of third-party rights.

8. PRIVACY & DATA

We collect: name, email, address, payment info (processed by Shopify Payments/Stripe - we do not store card numbers). We use Shopify, email marketing (if you opt-in). No sale of data. See full Privacy Policy. For GDPR/CCPA requests: support@smokedoutfitness.com.

9. THIRD-PARTY LINKS

Our site may link to Instagram (@smoked_out_fitness), YouTube, Printful. We are not responsible for their content.

10. GOVERNING LAW

These Terms governed by State of Maryland, Charles County jurisdiction. Any disputes resolved there.

11. CHANGES

We may update this Legal Notice anytime. Continued use after posting = acceptance. Check date above.
